CONSULTING SERVICES
Sentencing Narrative
When you face the Judge for sentencing, you need to put forth your very best case for the most lenient sentence. If you go into court and deny responsibility, display arrogance, consider yourself the victim by asking why this is happening to you - you will be sunk. The sentence that comes down will be harsh and long. You need to set the narrative of what happened. You must display genuine remorse and have that come across properly to the Court. You must take responsibility for your actions. You can explain them, but you cannot shirk responsibility. Saying the wrong thing at sentencing can have devastating consequences. You cannot minimize the damage and harm caused to the victim in your case. You have the get the Court to see you as a real person, with real emotions and feelings, and a genuine desire to change. DO NOT go into your sentencing without a properly drafted sentencing statement. We can help you write the best statement possible, to help achieve the best sentence possible. We can, because we have lived it.
Pre-Sentence Report Evaluation
Prior to your sentencing date, the Court will ask the Federal probation department to conduct a pre-sentence investigation which will result in a document called a Pre-Sentence report. In that report, the probation department will recommend a sentence to your Judge that they think is appropriate. You will be interviewed, asked a long series of questions about the crime you committed, your past, your education, family, finances and many other areas of your life. You will be asked about drug and alcohol abuse and addiction in your life. If you do not have this documented in your Pre-Sentence Report, you can all but forget about getting into the RDAP program and having your sentence reduced. While your lawyer can be present during this interview, what you say and how you say it will have an enormous impact on your future. Often times the Pre-Sentence report will advocate for a much harsher sentence than even your plea negotiations. How will you fully prepare yourself for this crucial step in the system? You must be prepared in advance and know everything there is to know. DO NOT go into this alone and unprepared
RDAP EVALUATION & CONSULTATION
RDAP stands for the Residential Drug Abuse Program - and it may be the only legitimate, realistic way for you to reduce your sentence by up to 18 months - just like our Founder, Michael, did. RDAP is is an intensive nine-month, 500-hour substance abuse rehabilitation program administered by the United States Federal Bureau of Prisons (BOP), offered to federal prisoners who qualify and voluntarily elect to enroll. Qualify is the key term here. Most future inmates have no idea how to qualify for this massively important program. Upon successful completion of the program, prisoners who meet the necessary criteria are eligible for up to a 12-month reduction of their sentence and possibly six months in a halfway house depending on how many months they have left on their sentence. Due to the high demand and insufficient spots, inmates are placed on a waiting list typically when they have 12 months or less time left on their sentence and are accepted when there is an opening. You MUST have everything prepared well BEFORE reporting to prison if you will have any chance of making it into this program. PLEA AGREEMENT ANALYSIS
Your lawyer will negotiate the plea agreement for you, and you should always listen to his or her advice. But since a plea agreement is one of the most life-changing documents possible, you need a second set of eyes to analyze it from a real world, non-legal perspective. What am I agreeing to exactly? How will this affect my sentence? My time in prison? Which prison I am sent to? We analyze the indictment, the Sentencing Guidelines and your particular circumstances so as to determine the most likely federal sentencing guideline level and sentencing range. We will also analyze the plea documents from an outside view, so you and your lawyer may make a fully informed decision and know the potential repercussions of any plea you may enter. DO NOT sign off on anything unless you know all the facts.
FAMILY CONSULTATION
We find that families suffer the most when a loved one goes to prison for any length of time. Our consultants had spouses and children they left behind when they went to prison. How the family copes and heals from this traumatic event can really only be described by those who have been there. We will talk to you family, in whatever way makes you comfortable, to explain how they can deal with the situation in a healthy way, support their incarcerated loved one and maintain their own sanity and mental health, their “sense of normal”. We will even come out to your residence to sit down with you in the place you feel most comfortable, and get your family ready for the challenges ahead. DO NOT leave your family out of this; realize that they need support as well.
PRISON PLACEMENT
Where you serve your time is just as important - if not more important - than how much time you serve. Are you eligible for a camp? What are the differences between the penitentiary, medium, low and camp designations? What are the best facilities in the prison system and how do I get assigned there? There are major, substantive differences between a camp and a higher security facility that will affect your life. There are also major differences among facilities at the same level. Not all camps are the same, for example. DO NOT just accept wherever the BOP decides to send you. We will assist you in getting the best, safest prison designation you can.
SERVICES WHILE IN PRISON
So you have arrived in prison. Now what? How do you make sure you have money on your books for phone calls, e-mails and commissary? How can you make sure your visitation list includes everyone you want? How do you deal with unit staff, guards, administrators and the warden? What are cop outs and call outs? What happens if I am sent to the “hole”? How do I make sure I am getting all the halfway house time I deserve? How do I make sure the prison staff is even filling the papers out correctly? How do you navigate the very complex, bureaucratic internal prison system? Our support does not end when you cross the prison threshold. In prison is where you need us the most. We will help you handle problems that arise in prison, emotionally, physically and administratively. Once inside prison it is you versus everyone else. Prison is an upside down world - where you once may have had power and control, inside you have none. DO NOT make the mistake of thinking you can navigate this perilous journey alone. You need continued support, and we are here for you each step of the way.
SENTENCE REDUCTION
There is no parole in the Federal prison system. That means, with good time subtracted from your sentence, you will serve approximately 85% of the time you receive. Unless you know how to take advantage of certain methods to possibly reduce your sentence. These are few and far between in the federal system. You will find everyone has their own ideas of how to get a sentence reduced - this is especially true with the “jailhouse lawyers” inside prison. DO NOT believe everything you hear. You must have clear and accurate information about sentence reduction to even have a hope of taking advantage of your situation. We will help you explore every avenue to get the most time off of your sentence. There are no guarantees except one - you will fail if you do this yourself.
